Do you remember this post from a little while back: “Colorado Senate Candidate Ken Buck…” ? You remember that asshole who said that he was against abortion even in the case of rape and incest? Well, looks like ole boy is at again! From TheHuffingtonPost.com, the story reads in part; “Three weeks from Election Day, stories have suddenly emerged about Buck’s refusal to follow up on rape allegations involving a University of North Colorado student during his stint as Weld County District Attorney. He declined to file criminal charges against the alleged victim’s attacker on the belief that not enough evidence existed to win the case, a conclusion that is not entirely rare with such delicate cases.” Okay, that can be pretty reasonable to consider especially when knowing that our tax dollars could be wasted if strong enough evidence is not available. But… in this case, her attacker confessed that he felt like what he had done was regrettable and improper. Here’s an explicit excerpt on what the attacker says in the police report:
“I [the police officer] then asked [redacted] if he realized that the victim was intoxicated prior to coming to her house. He stated 10-15 minutes after he arrived, he knew the victim was drunk. He stated his only intention originally was to lay next to the victim. He did state that he realized the victim was drunk prior to him having sex with her. He stated he has known the victim for 4-5 years and has seen her drunk many times. He stated they have had sex many times when one of them was drunk. He states after more questioning that maybe once or twice the victim said no. He stated he thought the victim did say no while he was fingering her. He stated he does recall her rolling away and saying no. He stated he agreed and then a short time later began touching the victim’s back and again inserting his fingers into her vagina… he stated after he had intercourse with the victim and climaxed, that he pulled out. He stated when he did so, the victim was barely conscious and that’s when he realized he had done something wrong. [Redacted] stated he thought the victim did say no shortly after he had climaxed, and while he was still inside of her.”
You’ve got a barely conscious woman, who said or uttered “no” more than once, yet that’s not enough to bring charges? Hm… here are some interesting facts that a wise male reader wrote. I cut and pasted these because the last time I did my research on rape, acquaintance rape and date rate was a little over 6 years ago but his stats and research stands to be right on target for 2010. This reader wrote as follows:
* In the United States, 1.3 women are raped every minute. That results
in 78 rapes each hour, 1872 rapes each day, 56160 rapes ech month and
683,280 rapes each year.
* 1 out of every 3 American women will be sexually assulted in her lifetime. (That’s 1 out of every 3 of us women!!)
* The United States has the world’s highest rape rate of the countries
that publish such statistics. It’s 4 times higher than Germany, 13
times higher than England, and 20 times higher than Japan. (I only know of three other places where rape occurs more often; 1) Darfur, 2) The Congo and 3) South Africa.)
* 1 in 7 women will be raped by her husband. (I know 2 girlfriends where that happened before they got a divorce!)
* 83% of rape cases are ages 24 or under.
* 1 in 4 college women have either been raped or suffered attempted rape.
* 1 in 12 males students surveyed had commited acts that met the legal
definition of rape. Furthermore, 84% of the men who had commited such
acts said what they had done was definitely not rape.
* 75% of male students and 55% of female students involved in
acquintance rape had been drinking or using drugs. (He is only referring to college stats here, but date rape and acquaintence rape happens in junior high and high school too.)
* Only 16% of rapes are ever reported to the police.
These statistics should not be dismissed. I concur kimbanyc over at TheHuffingtonPost!
I think kids drinking to the point of passing out is very dangerous for more reasons than one, but it is a perfect mixture for date rape or acquaintence rape to potentially occur.
